Place an Account - Terms of Use

This agreement is made by and entered in between Silver & Associates, Ltd. And the Accepting Party of these terms, herein referred to as "Client", agree to the following terms:

Collection Services are available except where prohibited and shall be provided on the following terms of use:

• Collection Process: Silver & Associates, Ltd. (S&A) will make written, telephone, fax, email, page and/or personal demands for payment on behalf of the "client".
• Fees: S&A shall handle accounts placed by "Clients" on a contingency basis, and shall not charge fees if it does not collect.

• Direct Payments: "Client" agrees to immediately notify S&A of all direct payments received after accounts are submitted to S&A for collection.
• Partial Payments & Settlements: S&A will not establish any arrangements without the approval of the "Client."
• Silver & Associates does not accept personal lines, second assignments, or judgments for collection.
• Litigation: S&A will not forward any account for litigation without the approval of the "Client." S&A will notify the "Client" of the court costs and/or suit requirements in advance. In the event of any counter claim, "Client" will have the option of utilizing recommended counsel or "Client" may elect to secure their own representation in defense of such counterclaims. S&A acknowledges that the assigned attorneys represent the "Client" and not S&A.
• Compliance: S&A shall comply fully with any instructions received from the "Client" with regards to the collection of accounts or the procedure to be used in connection thereof.
